Accurate as of August 2026. Short-term rental regulation in Portugal has changed direction more than once in the last few years — always confirm current rules with your lawyer or your local câmara municipal before relying on this for a live purchase.

If you're buying with an eye on Airbnb or Booking.com income, the licence you need is called Alojamento Local, or AL. Here's what it actually involves, what changed recently, and what it costs to get wrong — and if you haven't chosen a lawyer yet, this is exactly the kind of process worth having one guide you through.

What is Alojamento Local, and do I actually need one?

Alojamento Local is the legal licence required to let a property short-term to tourists in Portugal. If you're planning to list a villa or apartment on Airbnb, Booking.com, or similar platforms, you cannot do so legally without one — the listing itself requires your RNAL registration number to appear on it.

How do I register a property for AL in the Algarve?

The core steps, as they currently stand:

  1. Verify the property's usage licence and check whether it sits in a "containment zone" with local restrictions.

  2. Review your condominium rules, since these can affect short-term letting in shared buildings.

  3. Register the activity with Finanças (the tax authority) under CAE code 55201.

  4. Take out civil liability insurance with a minimum of €75,000 cover — submission of this insurance to the official portal has been mandatory since March 2025.

  5. Prepare a statement of responsibility (termo de responsabilidade).

  6. Submit a prior communication (comunicação prévia) through the ePortugal platform.

  7. Wait for the municipality's response — up to 60 days in most areas, or 90 days if the property falls in a containment zone.

Once approved, you're issued an RNAL registration number, which has to appear on every listing and every piece of promotional material for the property.

Are there restrictions on new AL licences in the Algarve?

Not currently, and this is worth knowing because the picture has shifted a lot recently. Under the "Mais Habitação" law introduced in 2023, Portugal froze new AL registrations nationally. That freeze was reversed by Decreto-Lei 76/2024 — licences are now permanent and transferable rather than expiring every five years, and the national registration freeze has been lifted.

Lisbon and Porto both still have "absolute containment zones" — specific parishes where no new AL registrations are permitted at all. As things stand, there is no regional freeze in the Algarve, and the region remains open to new registrations. That said, individual municipalities retain the power to set local regulations or temporary suspensions in specific areas under housing pressure, so it's worth checking with the relevant câmara municipal for the exact street or neighbourhood you're buying in before assuming a licence will be straightforward — rules can vary block by block in ways a general guide can't capture.

What does it cost to get this wrong?

Meaningfully more than most owners expect, and enforcement has tightened. Operating without RNAL registration is now treated as a grave economic offence, with fines scaled by the type of operator:

  • Individuals: €650–€1,500

  • Micro companies: €1,700–€3,000

  • Small companies: €4,000–€8,000

  • Medium companies: €8,000–€16,000

  • Large companies: €12,000–€24,000

If you've seen figures like €2,500–€40,000 quoted elsewhere online, those are outdated — that penalty range was repealed in 2021 and no longer applies. Worth knowing, since a lot of older content online still cites it.

What else do I need to stay compliant once I'm operating?

Beyond the licence itself: civil liability insurance kept current, safety equipment and clear emergency access maintained, listing details that accurately match your registration, and proper booking and tax records. Local councils are paying closer attention to compliance and safety standards, with a particular focus on safety equipment, emergency access and occupancy limits during inspections — this isn't a "register once and forget it" licence.

You'll also need to collect and remit a municipal tourist tax from guests. In the Algarve this generally runs €1–€2 per guest per night, depending on the specific municipality, and it's your responsibility to collect and pass it on to the local council — this is separate from the AL licence itself.
